Constitutional Chamber to consider lawfulness of postponement of repeat parliamentary elections in Kyrgyzstan on Dec 2

AKIPRESS.COM - The panel of judges of the Constitutional Chamber scheduled consideration of the motion filed by citizens Nurbek Kasymbekov, Talaibek Usubaliev and Reforma party challenging postponement of the repeat parliamentary elections in Kyrgyzstan, for December 2.
The Constitutional Chamber said earlier these two motions will be considered as one case.
On October 22, the Parliament of Kyrgyzstan passed the draft law postponing the repeat parliamentary elections earlier scheduled by the Central Election Commission for December 20 until June 1 motivated by constitutional reform.
The postponement of parliamentary elections beyond the time limit determined by the constitutional duration of the mandate of the outgoing parliament, hence the prorogatio of the latter's powers, should be supported by special justifications and extraordinary circumstances. The constitutional law approved by the Kyrgyz Parliament on October 22 does not reflect genuine democratic principles, although it does not openly violate any explicit constitutional provision: in the first place, the postponement of the elections of the new Parliament until June 2021 gives the Parliament in office 6 to 8 more months of power, which is a long period of time, much longer than the usual few weeks necessary to carry out the electoral activities, the Venice Commission said in its urgent amicus curiae brief relating to the postponement of parliamentary elections in Kyrgyzstan motivated by constitutional reform.
